By accessing or using the Testifai platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Service.
Testifai is an AI-powered test case management platform that enables organizations to generate, manage, and organize software test cases. The Service includes features such as AI-driven test case generation from user stories, test execution management, integration with development tools (GitLab, Jira, GitHub, Notion), an AI agent assistant, and related functionality. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account, notify us immediately of any unauthorized use, and not share your account credentials with others. Tenant administrators are responsible for managing user access within their organization, including role assignments and permission settings.
You agree not to use the Service to: violate any applicable laws or regulations; upload or transmit malicious code, viruses, or harmful content; attempt to gain unauthorized access to other accounts, systems, or data; interfere with or disrupt the integrity or performance of the Service; reverse engineer, decompile, or disassemble any part of the Service; use the Service to develop a competing product; exceed rate limits or abuse API endpoints; or share or resell access to the Service without authorization.
The Service, including its software, design, documentation, and branding, is the intellectual property of Testifai and is protected by copyright, trademark, and other intellectual property laws. You retain full ownership of all content, data, and test cases you create using the Service. Testifai does not claim any intellectual property rights over your content. AI-generated test cases are owned by you and your organization.
Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis as selected during plan enrollment. All fees are quoted and charged in Saudi Riyals (SAR) for domestic customers or US Dollars (USD) for international customers. Payments are processed through our authorized payment gateways. You agree to provide accurate billing information and authorize recurring charges. Refunds are handled in accordance with our refund policy. AI credit top-ups are non-refundable once consumed.
To the maximum extent permitted by law, Testifai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total aggregate liability for any claims relating to the Service shall not exceed the amount you paid to Testifai in the twelve (12) months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
Either party may terminate these Terms at any time. You may cancel your subscription and close your account through the platform settings. Testifai may suspend or terminate your access if you violate these Terms, fail to pay fees when due, or if required by law. Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period to allow you to export it, after which it will be securely deleted in accordance with our data retention policy.
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Kingdom of Saudi Arabia. Both parties agree to submit to the personal jurisdiction of such courts and waive any objections to venue.
